INPUT SOUGHT ON GUARDIANSHIP, PLANNING REGULATIONS

 


VICTORIA – Government is seeking input on proposed regulations necessary to bring into force the Adult Guardianship and Planning Statutes Amendment Act passed in the fall 2007 legislative session.

 

The new act will clarify, strengthen and update the laws relating to adult guardianship and incapacity planning instruments, including advance directives, representation agreements and enduring powers of attorney. It will ensure adults have effective tools to plan for the future, should they become incapacitated and unable to make decisions. The act will also ensure a modernized guardianship system is in place for a person who has decided not to make a plan or whose plan fails.

 

Proposed regulations relating to adult guardianship include matters such as procedures for assessments of incapability, remuneration of guardians and recognizing extrajurisdictional guardianship orders. Proposed regulations relating to the incapacity planning instruments address matters such as record keeping requirements and transitional issues.

           

The draft regulations are located on the Ministry of Attorney General website at www.ag.gov.bc.ca/legislation/current_Consultations.htm. Comments will be accepted until Dec. 15, 2008.
